What do the terms of use govern?

They govern browsing on this domain and its subdomains (the "Site") and the use of the information and contact channels published there. They do not govern the provision of services.

DataRoad is a Portuguese Managed Service Provider. Its offering covers managed IT services, structured networks, business Wi-Fi, managed firewalls, cloud, backups, helpdesk and consulting.

The Site informs and promotes. It is not a binding offer within the meaning of Article 32 of the Portuguese Civil Code. Any service, IT Unlimited included, begins only once a written contract with its own terms has been signed.

When are they accepted and how can they change?

They are accepted on first access. Anyone using the contact or proposal forms confirms they have read them. Anyone who disagrees with any point should leave the Site.

DataRoad may revise the text whenever it sees fit, without notice. Each version applies from the day it is published, with the date at the top. Continuing to browse after a revision counts as acceptance, so it is worth returning to this page regularly.

Which uses of the Site are prohibited?

Browsing costs nothing. The restricted area is the Client Portal, at helpdesk.dataroad.pt, accessible only with credentials issued by DataRoad.

Lawful and diligent use is required. The following are prohibited:

  • Sabotage Damaging, overloading or stopping the Site, the servers or the networks that support it;
  • Intrusion Entering restricted areas or the systems of DataRoad or other entities without permission;
  • Infection Sending viruses, malware or any code that alters systems without authorisation;
  • Extraction Scraping, data mining or systematic data collection without prior written agreement;
  • Abuse Illegal purposes, fraud, defamation, offence or infringement of others' rights;
  • Impersonation Using another person's or company's identity in the forms.

In the event of a breach, DataRoad may take legal action and report it to the authorities. Protecting the browsing user's own equipment, with up-to-date antivirus and firewall, is the user's responsibility.

Who owns the trademarks and content?

They belong to DataRoad or to whoever licensed them to it: text, photography, video, graphics, logos, icons, code, design, navigation and databases. National and international copyright and industrial property law protects them.

DataRoad, "We do IT right" and "IT Unlimited" belong to DataRoad. Ubiquiti, Microsoft, Apple, Cisco, Fortinet, Sophos, Dell, HP, AWS, VMware and other brands mentioned belong to their owners and appear only to identify technical partnerships and certifications.

Copying, distributing, transforming or exploiting content requires written authorisation, save for legal exceptions. You may view, print and occasionally share on social media for personal use, provided you identify the source.

Does submitting a form create any obligation?

No. A contact or proposal request is only an initial expression of interest and binds no one. Actual work always requires a written contract.

Whoever fills in a form guarantees that the data is correct and up to date and is liable for any damage caused by false data. The Privacy Policy sets out how that data is processed.

How are personal data and cookies handled?

In accordance with the GDPR — Regulation (EU) 2016/679 — and Law 58/2019 (8 August), as detailed in the Privacy Policy. Cookies follow Law 41/2004 (18 August); preferences and withdrawal of consent are covered in the Cookie Policy.

Requests from data subjects go to the DPO: DPO@DATAROAD.PT.

Links to manufacturers, partners, review sites or social networks do not make DataRoad responsible for what is published there or for their privacy rules. Read the terms of each destination. A link does not prove a partnership or sponsorship, unless the Site says so.

Anyone wishing to link to the Site must follow three rules:

  1. not imply a partnership with, or endorsement by, DataRoad;
  2. not harm DataRoad's good name;
  3. not frame the Site's content (framing or an equivalent technique).

How far does DataRoad's liability for the Site extend?

DataRoad works to keep the Site online at all times, but does not guarantee the absence of faults, viruses or downtime. It may cut, restrict or change access without notice, for maintenance, updates, reorganisation or corrections.

The information is provided as is, with no guarantee of accuracy, timeliness, completeness or fitness for a purpose. To the maximum extent permitted by law, DataRoad accepts no liability for any damage — direct or indirect, incidental, consequential or punitive — caused by:

  • using the Site or being unable to use it;
  • decisions taken on the basis of what is read there;
  • outages or unavailability;
  • errors, omissions or inaccuracies;
  • third-party action, including intrusions and attacks.

Wilful misconduct, gross negligence and mandatory consumer protection rules are excepted.

Please note: this limit applies to the Site as a showcase. Liability for contracted services, such as IT Unlimited, is set out in the contract signed with each client, which takes precedence over these terms.

Why do named clients appear?

Success stories, testimonials, client names and logos are published to promote DataRoad's services, on the basis of the authorisation agreed with each client.

A client who would prefer not to appear writes to sales@dataroad.pt. Removal is carried out within a reasonable time.

Which law applies and where can complaints be made?

Portuguese law. Disputes over the use of the Site are heard in the courts of the Lisbon district, to the exclusion of any other.

Consumers may use, under Law 144/2015 (8 September), these alternative dispute resolution channels:

Complaints can also be filed in the Electronic Complaints Book (https://www.livroreclamacoes.pt), with a direct link in the footer.

Which general rules complete the text?

  • Invalid clause The invalidity of one clause does not affect the others.
  • Rights intact Not exercising a right, or exercising it late, does not amount to waiving it.
  • Entire agreement These terms, together with the Cookie Policy and the Privacy Policy, constitute everything agreed regarding the Site.
  • Reference version The Portuguese text prevails over any translation.
