Is my company in scope of NIS2?
If it is medium-sized or large and operates in a critical sector, probably yes. Sectors in scope include energy, transport, banking, health, water, digital infrastructure, ICT service management, public administration, postal services, waste, chemicals, food, manufacturing and research, and some cases apply regardless of size. The official determination is made through the self-assessment on MyCiber, and the burden lies with the organisation.
What if we are not in scope?
You will feel NIS2 from the customer side. Entities in scope have to manage supplier risk, with questionnaires, contractual clauses and documentary evidence. Anyone selling to hospitals, banks, energy, public administration or industry will be assessed.
What are the fines?
Up to €10 million or 2% of annual worldwide turnover for essential entities, whichever is higher. For important entities, up to €7 million or 1.4%. Management bodies are directly liable.
How quickly must an incident be reported?
Within 24 hours for the early warning, 72 hours for the notification with an assessment and 30 days for the final report. Without monitoring and logs, the 24 hours cannot be met.
Which technical measures are required?
Between 39 and 91, depending on the level: basic (39), substantial (75) or high (91), according to the risk profile. The methodology is based on the National Cybersecurity Reference Framework, aligned with NIST CSF 2.0.
Will DataRoad register us?
No. Registration and self-assessment are acts of the entity itself. We prepare the information and do the technical part: inventory, measures, monitoring, logs and incident response within the deadlines.
